1.Who we are and what this agreement covers
Pasaran is operated by Pasaran Marketplace, a company registered in Indonesia. These terms apply to the website at pasaran.id, its mobile interfaces, and every feature reached through them, including search, listings, messaging, offers, appointments, checkout and business tools.
By creating an account, publishing a listing, contacting a seller or completing a purchase, you accept these terms. If you use Pasaran on behalf of a company, you confirm you are authorised to bind that company, and "you" then means both you and the company.
We publish a dated version of this document and keep the previous versions available on request. Material changes are announced by email and by a notice on the site at least fourteen days before they take effect.
2.What Pasaran is, and what it is not
Pasaran is a venue. Sellers publish listings; buyers find them, ask questions and agree terms. Except where we say otherwise in the protected checkout section below, the contract for any sale, lease or service is between the buyer and the seller, and we are not a party to it.
We are not an estate agent, a notary, a PPAT, a vehicle dealer, an employment agency or a payment institution. We do not value property, certify documents, hold title, or advise on what any person or company may lawfully own, lease or operate in Indonesia.
- We check that a listing follows our rules — not that a deal is a good one.
- A verification badge means we saw a specific document or confirmed a specific fact. It is never an endorsement.
- Prices, availability, measurements and permit states are supplied by sellers and can change without notice.
Anything involving land, tenure, building permits or company structure should be reviewed by a licensed Indonesian notary or PPAT before you commit money. Nothing on Pasaran is a substitute for that review.
3.Eligibility and your account
You must be at least 18 years old to hold an account. One person may hold one personal account; a business may hold one business account with as many team members as its plan allows. Accounts may not be sold, shared or transferred.
You are responsible for everything done through your account, so keep your password to yourself and turn on two-step verification. Tell us immediately if you believe someone else has access; we can suspend the account while it is secured.
The details on your account must be accurate and kept up to date. Verification requires a government-issued document, and for business accounts the company registration. We may refuse, limit or close an account where the information is false, where documents cannot be confirmed, or where the account is linked to a previously removed one.
4.Listings and the content you publish
You may only list something you actually have, and you must describe it as it is. Photographs must be of the item or property itself, taken recently. Where a listing states a certificate type, a lease term, a permit, a registration document or a mileage figure, that statement must match the paperwork you hold.
You keep ownership of the text and images you upload. By publishing them you grant us a worldwide, non-exclusive, royalty-free licence to host, resize, index and display them for the purpose of running and promoting the marketplace. The licence ends when the listing is removed, except for copies kept in backups or required for a dispute or a legal obligation.
The detailed requirements are in the listing rules, and the categories we do not allow at all are in the prohibited items policy. Both form part of this agreement.
- Do not publish someone else’s photographs, floor plans or copy without their permission.
- Do not list a property you do not control, and do not relist another agent’s listing as your own.
- Do not include contact details in images or titles to route buyers off the platform before the rules allow it.
5.How you are expected to behave
Treat other people on Pasaran as you would in a shop or at a viewing. The community guidelines describe this in full, and they apply to listings, message threads, reviews, storefronts and anything else you can write.
Automated collection of listings or member details, attempts to bypass rate limits or access controls, and any interference with the security of the service are prohibited. So is using Pasaran to advertise a competing marketplace or to recruit our members onto one.
6.Transactions, offers and appointments
Making an offer through Pasaran is a genuine expression of intent. Sellers who accept an offer are expected to honour it, and buyers who make one are expected to follow through. Repeatedly withdrawing accepted offers is treated as a rule breach.
Appointments booked through the platform are commitments to both parties. Cancel through the thread rather than silently not appearing; no-shows are recorded and affect the reliability figures shown on a profile.
Where a purchase goes through protected checkout, the payment is held by our payment partner until you confirm the item arrived as described or the confirmation window closes. The buyer protection policy sets out what is covered, the time limits, and how a claim is decided.
Payments arranged outside Pasaran are outside every protection we offer. If a seller asks you to move a payment to a personal bank transfer, a wallet or a messaging app, stop and report the listing.
7.Fees, plans and refunds
Browsing, searching, messaging and a limited number of listings are free. Fees apply to promotion packages, business plans, and — where checkout is used — a service fee shown before the payment is confirmed. Every fee is quoted in Indonesian rupiah and includes applicable Indonesian value added tax unless stated otherwise.
Subscription plans renew automatically at the end of each period until cancelled. Upgrades take effect immediately and are charged pro rata; downgrades take effect at the end of the current period. Cancelling stops the next renewal and leaves the plan running until the period ends.
Promotion purchases are consumed when the promotion starts running and are not refundable once a listing has been shown under it. Where a promotion could not run because of a fault on our side, we credit the equivalent value back to the account.
8.Moderation, suspension and removal
We review listings before they go live in the higher-risk categories and continuously afterwards, using both automated checks and human reviewers. We may edit a listing’s category, remove images that breach the rules, ask for a document, or take a listing down.
Where an account repeatedly breaks the rules, or where we see credible evidence of fraud, impersonation or a threat to another member, we may restrict features, suspend the account or close it. We tell you what happened and why, unless doing so would compromise an investigation or breach a legal obligation.
Every enforcement decision can be appealed. An appeal goes to a reviewer who did not make the original decision, and we aim to answer within two working days.
9.Our intellectual property
The Pasaran name, logo, interface design, category taxonomy and the software behind the site belong to us or our licensors. You may not copy, adapt, reverse engineer or redistribute them, and you may not present Pasaran content as your own product.
If you believe content on Pasaran infringes your copyright or trade mark, write to us with the material in question, the right you hold and your contact details. We remove infringing content promptly and repeat infringers lose their accounts.
10.Availability, warranties and liability
We work to keep Pasaran available and accurate, but the service is provided as it is. We do not warrant that listings are error-free, that a seller will complete a deal, or that the service will be uninterrupted; maintenance windows and outages happen.
To the fullest extent Indonesian law allows, we are not liable for indirect or consequential loss, for lost profits or opportunities, or for the acts of another member. Where we are found liable, our total liability for any claim is limited to the greater of the fees you paid us in the twelve months before the claim, or one million rupiah.
Nothing in this section limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
11.Ending the agreement
You may close your account at any time from account settings. Closing it removes your listings from search, ends any active plan at the end of the paid period, and starts the deletion timetable set out in the privacy policy. Message threads relating to a completed transaction are retained for the period required for dispute and tax purposes.
We may end this agreement by closing your account where you have materially breached these terms, where we are required to by law, or where we cease to operate the service. Where we close a paid account without a breach on your side, we refund the unused portion of the plan.
12.Governing law and how disputes are resolved
These terms are governed by the laws of the Republic of Indonesia. We ask that you contact support first — most disagreements are resolved that way within a few days, and it costs neither side anything.
If a dispute cannot be settled informally within thirty days, it is submitted to the competent court in Denpasar, Bali, unless a mandatory consumer protection rule gives you the right to bring it elsewhere. This does not prevent either party from seeking urgent injunctive relief.
If any provision of these terms is held unenforceable, the rest continues to apply. Our failure to enforce a provision on one occasion is not a waiver of it.
